When it comes to payroll processing, the IRS, state and local tax agencies have made the payroll function very time consuming and quite complicated for the small business owner. Our firm can help a small business process its payroll each pay period and help prepare paychecks or direct deposit along with the quarterly and annual payroll tax reports. Our firm does not provide human resources or e-verify services. Our firm can help you with payroll processing as well as payroll tax and wage form preparation. Since we do not engage in employment legal matters or human resources, it is incumbent for each employer to be fully aware of the changing employment laws related to human resources, hiring, firing, minimum wage rules and tip credits, overtime pay, workman's compensation requirements, determination of employee vs. independent contractor, and all other employer - employee related legal matters. The scope of our payroll services is limited to our firm assisting small business clients with their actual payroll processing, accounting entries, tax and wage form preparation based on actual wage amounts paid by the client to its employees. Matters related to employment and wage law are the responsibility of the small business owner, its managers, and not within our payroll service framework. It is the duty of the employer to present us with the completed W4 forms for employees and actual payroll information for wage amounts each pay period. The employers are responsible for giving their employees notice for any changes related to their compensation regarding gross wages, tips, credits or deductions from their paychecks. Our firm does not handle such matters nor does it determine the classification of employee vs. independent contractor as the small business owner or manager should seek legal counsel for this determination. The employer should make sure that they are in compliance with all of the current FLSA regulations and should seek sound employment legal counsel for any questions related to such matters. Our firm does not provide this advice and such consultations or advice are beyond the scope of our payroll processing services. Our firm does not determine whether or not the employer is required to provided minimimum essential health care coverage to its employees. All compliance matters related to employer provided health insurance or the Affordable Care Act is the responsibilty of the employer and is beyond the scope of our payroll processing services. The employer calculates actual wage amounts paid and presents this information to us each pay period. The employer should be aware of minimum wage requirements, and tip credits if applicable, as well as any overtime amounts and provide us with this same information each pay period. We do not determine the amount of overtime requirement, or what the minimum wage or tip credit amount should be, nor whether or not employees are entitled to such amounts. We rely on the employer to present our firm with this information for payroll processing. Employers shall be responsible for their own E-Verify process and need to check the proper legal work eligibilty for each of its new hires and employees. Employers need to verify identification for their employees as well as the information shown on their employees' completed W4 Forms that are given to our firm as part of the payroll process. We shall not be held liable for any E-Verify or worker eligibility requirements as this is the employer's responsibility. Our firm will efficiently process the payroll amounts given to us by the client each pay period into our accounting system to generate employee paychecks while helping keep the client in payroll tax compliance. The employer is ultimately responsible for keeping its business in compliance with the tax authorities, human resources law, employment law and wage law. Any tax advice or other information provided by our firm, its employees or agents shall not be used to avoid tax penalties and such advice shall not be relied upon unless it is in written form.
